1. Agreement to Terms
By engaging Water Worx Irrigation (“Company,” “we,” “our,” “us” or "Water Worx") for services, requesting a quote, or using our website, you agree to these Terms of Service.
These Terms apply to all customers, including residential and commercial clients.
2. Services Provided
Water Worx provides services including, but not limited to:

Irrigation system installation, repair, and maintenance

Landscaping services
-
Outdoor lighting installation and maintenance
All services are subject to availability, site conditions, and scope as defined in the approved estimate, invoice, or service agreement.
3. Estimates and Scope of Work

All estimates are based on visible conditions at the time of inspection.

Final pricing may change if unforeseen conditions arise (e.g., buried obstacles, system damage, soil conditions).

Any changes to scope will be communicated and approved before additional work is completed.
4. Scheduling and Access

Customers agree to provide reasonable access to the property at scheduled service times.

Delays due to weather, site conditions, or access restrictions may result in rescheduling.

Water Worx is not responsible for delays caused by factors outside of our control.
5. Payments

Payment terms will be outlined in your estimate or invoice.

Payment is due upon completion unless otherwise agreed in writing.

Late payments may be subject to fees or service delays.
For larger installation or project-based work:

Deposits may be required prior to scheduling or material procurement
-
Progress payments may be required based on project milestones
-
Final payment is due upon substantial completion
Substantial Completion
“Substantial completion” means the project or service is sufficiently complete such that it can be used for its intended purpose, even if minor items, adjustments, or corrections remain.
Minor items (including aesthetic preferences, small adjustments, or punch list items) do not delay or prevent final payment.
Deposits are non-refundable once materials are purchased or work has begun.
Delays caused by weather, material availability, or site conditions may impact timelines and do not constitute grounds for withholding payment.
6. Warranties
Water Worx may provide a limited workmanship warranty on certain services, as explicitly stated in the applicable estimate, invoice, or written service agreement.
Unless otherwise specified in writing, no ongoing warranty is provided.
Manufacturer warranties apply to parts and equipment where applicable and are subject to the manufacturer’s terms and conditions.
Warranty coverage does not apply to:

Damage caused by weather, freezing, ground movement, or natural events

Misuse, neglect, or improper operation
-
Modifications or repairs performed by others
-
Normal wear and tear
7. Property Conditions and Liability

Customers are responsible for identifying and marking private utilities, lines, and property features not visible or disclosed prior to work.

Water Worx is not liable for damage to:
-
Unmarked underground utilities
-
Hidden structures or materials
-
Pre-existing system issues
-
-
While reasonable care is taken, minor disturbances to landscaping may occur during service.
8. Irrigation System Responsibility

Proper system performance depends on water pressure, municipal supply, and system design.
-
Seasonal maintenance (including winterization, system adjustments, and inspections) is the customer’s responsibility unless covered under a separate written service agreement with Water Worx.

Water Worx is not responsible for plant health, lawn condition, or water usage outcomes.
9. Outdoor Lighting and Electrical Systems
Outdoor lighting systems must be used and maintained in accordance with manufacturer guidelines and applicable safety standards.
Water Worx is not responsible for injury, damage, or system failure resulting from:

Customer misuse or tampering

Unauthorized modifications or repairs
-
Damage occurring after installation
10. Cancellations and Refunds

Customers must provide at least 24 hours’ notice to cancel or reschedule a scheduled service.

Cancellations made with insufficient notice may be subject to a service fee.
-
If a service team is dispatched and unable to complete work due to lack of access, cancellation, or customer delay, a trip charge may apply.

Deposits are non-refundable once materials are purchased or work has begun.
-
Refunds will not be provided for completed services.
For partially completed projects:

Labor and completed work are non-refundable
-
Unused, uninstalled materials may be eligible for refund at Water Worx’s discretion
11. Right to Cure
If a customer believes that services have not been performed in accordance with the agreed scope, the customer must provide written notice to Water Worx detailing the issue.
Water Worx will be given a reasonable opportunity to inspect and correct the issue before any third-party work is performed or any claim is made.
Failure to provide Water Worx the opportunity to cure the issue may limit or void any claims related to the services performed.
12. Communication and Marketing
By interacting with Water Worx, you agree that we may contact you via phone, text message, or email regarding services, scheduling, and related communications.
Marketing communications may be sent where permitted by law. You may opt out at any time.

13. Website Use

14. Limitation of Liability
To the fullest extent permitted by law:

Total liability is limited to the amount paid for the specific service performed
15. Indemnification
Customers agree to indemnify and hold Water Worx harmless from any claims, damages, or expenses arising from:

Undisclosed or unknown property conditions

Customer misuse of systems

Third-party interference or modifications
-
Failure to properly maintain installed systems

Or any similar circumstances outside of Water Worx’s control
16. Service Agreements
Recurring maintenance or service plans are governed by separate written agreements.
These agreements may include defined service schedules, pricing, and cancellation terms.
Either party may terminate a service agreement in accordance with the terms outlined in that agreement.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18. Changes to Terms
Water Worx may update these Terms of Service at any time. Updated terms will be posted on our website with a revised effective date.
19. Governing Law
These Terms are governed by the laws of the State of Texas.
